The City Coroner autopsy said no asphyxiation. The Floyd’s funded autopsy says asphyxiation Do we go to a tie-breaker?

The City Coroner's report was preliminary. Should wait for a final report.

Always heard "3 4 5 keep the diaphragm alive" meaning the 3rd, 4th and 5th cervical vertebrae.

Well, the Hennepin County Medical Examiner officially declared it a homicide. All they said is that they could not assign asphyxiation as the cause of death as there was no clear cut signs of it. What they did not say is that asphyxiation was ruled out as a possibility. It is not uncommon for someone who was asphyxiated to show no signs of it. The ME officially declared that he died from a stopping of the heart caused by being restrained by the police. Notably, one of the causes for cardiac arrest can be asphyxiation...
Yes, the two could both testify at trial, but neither of the MEs are good news for the officers.

"C-3-4-5 keep the diaphragm alive" refers to the 3rd, 4th, and 5th cervical spinal nerve roots which provide the nerve fibers to the phrenic nerve which innervates the diaphragm. It's a pneumonic commonly used by medical students.
These nerve roots are unlikely to be injured by neck compression, but the latter can certainly obstruct the trachea sufficiently to cause asphyxia.
