Definitely in agreement with these verdicts. Never before heard of “unintentional murder” but if that was what was deemed necessary to help ensure this outcome then good job with the wording of the charges. This really bad cop’s actions killed many more people than just George Floyd so society should be finished with him and he should sit in jail for the rest of his life. |
A lot of the time it's just referred to as ”felony murder".
If the state can prove that someone caused the death of another person during the intentional commission of another felony (excluding sexual assault in the first or second degree), but did not intend to bring about their death, then they are guilty of second degree murder.
If the person intentionally killed another during the commission of a felony (or the felony in question is first or second degree sexual assault), then they are guilty of "felony murder" in the first degree.
Basically that it happens during the commission of another felony serves to up the charge a level. So unintentionally killing someone ceases to be manslaughter and becomes Murder 2, and intentional homicide (but not premeditated) becomes Murder 1, as if it were premeditated.
In this case the prosecution argued that Chauvin intentionally committed the felony of assault against Floyd during which his actions caused Floyd's death. The jury obviously overwhelmingly agreed, as evidenced by the short deliberation.

Now on that I agree with you, Howee.
Probably going to leave it right there for the rest of the day. _________________ Every woman who has ever been presented with a career/sex quid pro quo in the entertainment industry should come forward and simply say, “Me, too.” - jammer The New York Times 10/10/17 |
