The Supreme Court Has a Chance To End Qualified Immunity and Prevent Cases Like George Floyd's

https://reason.com/2020/05/29/the-supreme-court-has-a-chance-to-end-qualified-immunity-and-prevent-cases-like-george-floyds/

Quote:
While it may seem like George Floyd's right to not be choked to death by a police officer would be rather obvious, the fuzzy phrase "clearly established" has evolved over time to become a pedantic and unforgiving standard. Plaintiffs are often required to go fishing for cases that match their exact circumstances, lest their lawsuit get tossed. Last year, a 9th Circuit Court of Appeals panel granted qualified immunity to an officer who, without warning, shot a 15-year-old holding an airsoft gun.

Both Sonia Sotomayor and Clarence Thomas have expressed concern over the doctrine's application, and those two are not often in agreement.

National security adviser: 'I don't think there's systemic racism' in US police forces

Quote:
"No, I don't think there's systemic racism. I think 99.9% of our law enforcement officers are great Americans. Many of them are African American, Hispanic, Asian, they're working the toughest neighborhood, they've got the hardest jobs to do in this country and I think they're amazing, great Americans," O'Brien told CNN's Jake Tapper on "State of the Union" when asked if systemic racism was a problem for police agencies.

Was wondering when good ol' Bob KKKroll was going to slither his way out of the slime and make his presence known.

The Minneapolis Police Chief Promised Change. He Got a Disaster
https://www.wsj.com/articles/a-minneapolis-police-chief-promised-change-george-floyds-death-shows-hurdles-11590971860

Quote:
When Medaria Arradondo became this city’s first black police chief in 2017, the department was in trouble. His predecessor had abruptly resigned after an officer killed an Australian woman who called for help, and a spate of shootings of minorities was straining an already fraught relationship with the city’s black community.

Naysayers will look at the "commissioned for George Floyd's family" and immediately discount it.

The City Coroner autopsy said no asphyxiation. The Floyd’s funded autopsy says asphyxiation Do we go to a tie-breaker?

The City Coroner's report was preliminary. Should wait for a final report.

That's what I was thinking. Both can be expected to be given as evidence in court.

Always heard "3 4 5 keep the diaphragm alive" meaning the 3rd, 4th and 5th cervical vertebrae.

That's what I was thinking. Both can be expected to be given as evidence in court.

Well, the Hennepin County Medical Examiner officially declared it a homicide. All they said is that they could not assign asphyxiation as the cause of death as there was no clear cut signs of it. What they did not say is that asphyxiation was ruled out as a possibility. It is not uncommon for someone who was asphyxiated to show no signs of it. The ME officially declared that he died from a stopping of the heart caused by being restrained by the police. Notably, one of the causes for cardiac arrest can be asphyxiation...

Yes, the two could both testify at trial, but neither of the MEs are good news for the officers.

NYPD Officers Take Knee In Solidarity With Protesters; De Blasio Praises Them For ‘Listening, Working With The Community’

Quote:
“Showing the NYPD is listening, working with the community. This kind of thing, our police leadership reaching out, connecting with the community. This is the entire concept of neighborhood policing, and that’s true in the middle of this difficult moment. In fact, it is how we’re going to overcome this moment and move forward,” said Mayor Bill de Blasio. “I commend and I thank all the police leaders who found a way to reach out, listen and connect and the restraint of so many of our officers.”

Seth Rogen blasts followers criticizing his support of Black Lives Matter: 'You don't deserve my movies'

Quote:
Every fan who thought Seth Rogen was just the bumbling pothead in every comedy learned their lesson on Monday. The actor didn't come to play when he blasted commenters on social media for criticizing his support of Black Lives Matter and protestors speaking out against George Floyd's death.

Rogen first made that clear with his Instagram post bearing the BLM logo. "If this is a remotely controversial statement to you, feel free to unfollow me," he captioned the image.

It remains a shocking failure that many African Americans, especially young African American men, are harassed and threatened in their own country. It is a strength when protesters, protected by responsible law enforcement, march for a better future.

"C-3-4-5 keep the diaphragm alive" refers to the 3rd, 4th, and 5th cervical spinal nerve roots which provide the nerve fibers to the phrenic nerve which innervates the diaphragm. It's a pneumonic commonly used by medical students.

These nerve roots are unlikely to be injured by neck compression, but the latter can certainly obstruct the trachea sufficiently to cause asphyxia.
