Gregg Jarrett: What is Robert Mueller investigating (since collusion is not a crime)?
Quote: |
Robert Mueller is tasked with finding a crime that does not exist in the law. It is a legal impossibility.
As special counsel, Mueller can engage in all manner of spectacular jurisprudential gymnastics. However, it will not change the fact that colluding with Russia is not, under America’s criminal codes, a crime. It’s just not there. |

There are dozens of potential crimes. There are many criminal statutes covering for example false statements to investigators, to Congress, on various forms, etc. There are numerous statutes criminalizing obstruction of justice, obstruction of a federal investigation, etc. There are a variety of conflict of interest and other crimes involving acceptance of money or favors or employment. There are general fraud statutes. If they colluded with a foreign nation to influence the outcome of an election it might violate various election corruption laws. And conspiracy to commit or aiding and abetting any of these or other crimes is itself a crime even if you're not guilty of the substantive crime yourself.
Finding a criminal statute covering the conduct is the least of their problems.

In his opening statement, Brennan also recounted how he had briefed congressional leaders in August of last year, including House Speaker Paul Ryan, R-Wisc., Senate Majority Leader Mitch McConnell, R-Ky., and the chairs and ranking members of the House and Senate Intelligence Committees about the "full details" of what he knew of Russia's interference in the 2016 election. Brennan said he became convinced last summer that Russia was trying to interfere in the campaign, saying "they were very aggressive."
