I never said HRC ran a perfect campaign, nor am I interested in re-litigating the election. What I am interested in is making sure the popular criticism of HRC is called out for being the bullshit that it is.

No one knows if Trump is constitutionally impeached as of right now. Some say he's not impeached until the house managers deliver the articles of impeachment to the Senate -- that is, a vote for impeachment is not THE impeachment. Others say the vote for the impeachment IS the impeachment. We are in constitutional never-never-land.

I was listening to Earl Blumenauer (OR, I think) on CNN.

He made an interesting comment. He said that the articles of impeachment are good forever. basically. He said that they would be good in a week, a month or a year, they don't go away.

So, here's where my mind went...

Is there ANY way possible the dems could win majority in the senate?????

Could Nancy hold on to them until after the 2020 election and let's say the Dems ARE in control of the senate and McConnell is out on his ass, submit them on Jan. 1?

Or even wait until after the 2020 election and submit them regardless of who is in control of the senate? Maybe McConnell won't be there for some reason and the process would be maybe something that resembles fair??

It takes 2/3 to remove the president. They're not getting that.

This is constitutional unknown territory, since it's never happened.

Two constitutional pundits I've read today say that the articles would die when the current two-year session of Congress ends in 13 months. The analogy is to bills and legislation. All bills die at the end of a Congressional session if they haven't been signed into law by the president. This includes bills that have not yet been enacted by either branch of Congress, bills that have been enacted by only one branch, the House or Senate, as well as bills that have been enacted by both branches but not yet signed by the president. The rationale is that a brand new group of Congresspeople shouldn't be bound or beholden to their predecessors for things that have not been fully enacted into law.

To me, this is the better view for a unicameral vote such as the articles of impeachment. But if a carryover actually happened, its life or death would probably depend on a law suit that would have to be decided by the Supreme Court.
