A Chicago judge denied an attempt by R. Kelly’s attorneys to have Illinois’ child pornography statute declared unconstitutional. Kelly’s lawyers were challenging the law in hopes that its removal would lead to a dismissal of Kelly’s criminal indictment. While prosecutors contend the girl was indeed under the age of 18, and Illinois law states that it is illegal to take pictures of someone 17 or younger while engaging in sex, Kelly’s team argued that the law should be unconstitutional because it is not always illegal to have sex with a 17-year-old, and it is not illegal to use a camera.
