Certainly not uncommon by plaintiffs' lawyers, particularly in a case like this.

Generate sympathy, generate media coverage, create public pressure on the public institution to settle the case.

And generate some publicity for the law firm while they're at it.

What? You're not buying the law firm's description that it "prides itself as a firm known for representing the underdog" and "champions the causes of vulnerable individuals wronged by powerful corporate and government interests"?

It's a tough call. Was Burns wrong? Yes. Is she known as a super intense coach in the business? Absolutely. Competitive? Like no other. Is SDSU women's basketball anything without her? Probably not.

Reprimanded publicly would have been ok given the situation, but you have to also understand there might be other factors at play. Given what had happened at Rutgers with their men's coach, and if the lawsuit is right, they might have been looking at a reason to get rid of her.

It's sad - WBB needs successful programs to move the sport forward. SDSU is going back to some dark days, I'm guessing, though good luck to Terry.

Interesting. The two incidents seem somewhat different. The first she is gesturing and then slaps some papers or clipboard in the assistant's lap. Seem pretty innocuous and appears to have elicited no reaction at all from the assistant. The second she hits him in the shoulder for no apparent good reason. Probably not so innocuous and he does appear to react.

But I'm betting there was more to the story like some history between them.

But it is California, after all. If there's anywhere to win a suit against an employer, it's California.

This case is finally going to court with Burns claiming gender discrimination and that she was fired in retaliation for complaining about Title IX issues at SDSU, and SDSU claiming she was abusive to subordinates.

After reading this article, it's clear Burns hasn't changed. She is out of control and nothing is ever her fault. I watched it for 5 years. I was shocked that they hired her back.

Why would he need to be paid a settlement as he went out the door, if all this was, was an issue about her demanding equal treatment for women's athletic sports? And what are the particulars of the $250,000 settlement? Burns herself only made $220,00 a year as head coach.

And why, if Burns needs to vent her emotions by striking out, does she have to make sure it's someone else she strikes, and not herself? Why doesn't she slam her hands/fists down on her own lap, instead of someone else sitting beside her? If she is simply an emotional coach, I'm saying...

Steve Fisher [SDSU men's hoops coach] testifies in Beth Burns trial

...Most of Fisher’s answers were brief and measured, and it wasn’t until the final moments of his testimony that he offered more insight into his sentiments. It came after a question about whether he had “misgivings” about recommending Michael Bynum, a former student manager for the men’s team, for a position as videographer on Burns’ staff.

Bynum worked for Burns for five seasons and was instrumental in providing information to senior associate athletic director John David Wicker that ultimately led to her termination. Bynum wrote emails, at Wicker’s request, that chronicled incidents of alleged verbal abuse by Burns. He also testified last week that he cut the video of Burns elbowing Barrett on the bench and slid it under Wicker’s door without Barrett’s consent.

“Beth lost her job,” Fisher said, “and I think Mr. Bynum might have been involved in that process. So if that truly is the case, I recommended him and I feel badly that I recommended him.”...

Its becoming standard. The new rush to use Title IX as a winning lottery ticket is an example of where the real threat hanging over a University is a public relations nightmare that plaintiffs attorneys churn by the use of media outlets and their willingness to sensationalize almost any scenario.

SDSU's appeal of the previous judgment has finally worked its way through the legal system. The case has now been settled...the university pays more ($5.5-$6M), Burns gets less ($1.55M, down from $3.35M), and the attorneys finally get paid ($2.45M to hers and $1.9M to the school's). Note that she originally asked only for the $880K remaining on her contract and $25K in legal fees.

"Burns has not been hired as a head coach since. She was an assistant at USC for two years. This past season, she was an assistant at Louisville, which reached the Final Four of the NCAA women’s tournament.

Burns declined comment, but Chapin, her attorney, said: “There’s been significant collateral damage. I haven’t confirmed this, but I have it on rumor. She was a candidate for two head coaching jobs at Division I schools, and she was being recommended highly by people below the level of athletic director. The athletic directors both said they didn’t want someone running the program who had brought a Title IX action. So she’s been kind of blackballed.”"

That is the consequence she had to have known might happen to her...no one wants to possibly hire someone who has sued once and could do it again...not sure in the end if she still wants to be a head coach, the lawsuit was worth it...could have made more money serving as head coach for next 10 - 15 years then what she is actually getting in the long run...plus benefits + pension...

As I tell my students...actions have consequences..can you live with the outcome of your actions?
